Q: Why is the City of Kissimmee installing Red Light Cameras?
A: The City of Kissimmee has installed Red Light Cameras to address the public safety issue of red light runners.
Q: Where will the cameras be installed?
A: Cameras are mounted at intersections considered to either have a high traffic volume or where there has been repeat activity for red light violators.
Q: What do the traffic signal colors represent?
A: A green light means "Proceed with Caution"; the yellow light means "Prepare to Stop"; and the red light means "STOP".
Q: What is the penalty for running a red light in the City of Kissimmee?
A: If drivers fail to stop before the stop line before the traffic signal turns red, the cameras will capture the vehicle running through the intersection. This will result in a penalty in the amount of $158. This amount must be paid within 60 days of the violation. If not, a uniform traffic citation will be issued and the fine increases to $264.
Q: Does the $158 penalty amount go to the City or the Kissimmee Police Department?
A: The breakdown of the penalty for the violation, if paid within 60 days, is as follows:
$70.00 - State Department of Revenue: General Fund
$10.00 - Department of Revenue: Health Administrative Trust Fund
$3.00 - Department of Revenue: Brain and Spinal Cord Injury Trust Fund
$75.00 - Retained by the City. The amount that eventually goes directly to the City, if any, will depend on the number of violations and the number of violations paid within the 60 day period, versus the amount owed to the red light camera vendor for equipment reimbursement.
Q: Is a penalty issued for making a right turn on red?
A: Tickets will also be issued if a driver makes a right turn on red—before failing to come to a complete stop and if pedestrians are crossing the street or at intersections posted "No right turn on red".
Q: Is there an opportunity to appeal the violation?
A: The owner of the vehicle will receive a violation letter, which will include a link to a website, which shows a video of the violation and also explains the red light camera process.
Q: Who is responsible for the penalty—the owner of the vehicle or the person driving the car at the time of the violation?
A: The violation is issued to the registered owner of the vehicle who is responsible for payment, unless the owner can establish one of the following four allowable exemptions:
1. The motor vehicle passed through the intersection in order to yield right-of-way to an emergency vehicle or as part of a funeral procession;
2. The motor vehicle passed through the intersection at the direction of a law enforcement officer;
3. The motor vehicle was, at the time of the violation, in the care, custody, or control of another identifiable person.
