 Do I need a Business Tax Receipt (BTR) to Operate a Business?

Yes, any person pursuing trade or business, work out of their home, rent a short term dwelling, solicit or panhandle within City limits must obtain a Business Tax Receipt (BTR) from both Osceola County and the City of Kissimmee, prior to conducting business. 

Before a City Business Tax Receipt can be issued, a business must meet all conditions required by the city, county, state, and/or federal agency regulations, which apply to that business or occupation. Many businesses may be subject to zoning, building or development codes. It is strongly encouraged that you consult the Planning Division webpage or call us at 407.518.2146 before signing any contract or starting any construction to verify that your business is appropriate for the property in question. 

Once building construction has been completedmobility and impact fees have been paid, a final building inspection has been approved, and a Certificate of Occupancy has been issued... a Business Tax Receipt can be obtained. 

Most business tax fees are based on square footage, number of workers and/or category of profession.  In some cases, if a business performs several functions, it may also be necessary to acquire more than one Business Tax Receipt.   To find out these fees or to inquire if you would need more than 1 license, please contact the Building Division at 407.518.2379.

The City issues Business Tax Receipts for a period of 1 year.  BTR's must be renewed annually by September 30, and a license and fee must be paid.  A new license must also be obtained if the business will be transferring location or ownership, or if a separate branch location of the same business is opened.  Please note, it is the responsibility of the business owner to receive and renew a Business Tax Receipt annually.  Failure to receive, maintain or renew a Local Business Tax Receipt by September 30, subjects the owner to late fees.  To find out more information about renewals, please click HERE.   

 How Can I Obtain a Business Tax Receipt (BTR)?

For New Businesses:

If you are a first time applicant wishing to conduct a business out of a commercial or industrial location, a Business Tax Receipt can be obtained in 4 simple steps:

Step 1:  Determine where you would like to operate your business.  Consult the Planning Division webpage or call us at 407.518.2146 to verify that your proposed business is located inside the City limits and is zoned appropriately for the property in question.

Step 2:  Download and complete the Business Tax Receipt Application.  Submit it along with the applicable fees to the Building Division in person, mail to City of Kissimmee, Building Division, 101 Church Street, Suite 120, Kissimmee, FL  34741.

The information needed to obtain a Business Tax Receipt includes, but is not limited to the following items:

      • Business name; Owner(s) or President's Name; Mailing Address; Email Address; Physical Location of the Business; Telephone Number(s); Social Security or Federal ID Number; and a copy of the Fictitious Name Registration, where applicable.
      • If the business name used in your business does not include the full first name and last name of the business owner, the business name would be considered a Fictitious Name, and must be registered with the Florida Secretary of States Office (850.487.6058).  NOTE:  Corporations are registered with the Florida Secretary of State, for information call 850.487.6052.  Out of State corporations must register with the Secretary of State if they intend to use their corporate name.  For information call 850.487.6051.
      • Social Security or Federal ID numbers are obtained from the US Internal Revenue Service (1.800.829.3676 or 1.800.829.1040).
      • To obtain a Florida Sales Tax Number (resale number) contact the Florida Department of Revenue.  The Orlando location is 2301 Maitland Center Pkwy, Suite 160, Maitland, FL  32751-4191.  407.475.1200 or 1.800.352.3671.
      • Businesses regulated by the State of Florida or County agencies, a copy of all appropriate licenses or certificates.  Examples:

There are certain types of businesses that are required to show a state license, registration or other certification to obtain a new local BTR.  To find out more information, it is highly suggested to contact the Building Division at 407.518.2379 or permitting@kissimmee.org.

Any changes to an existing business must be reported to the City Building Division.  If a change of ownership has taken place, a notarized bill of sale must be presented to change the ownership of an existing business.  If you discontinue (close) your business, contact the Building Division to inactivate your account.

For Home Businesses:
If you are a homeowner who wishes to conduct business from your home, a Business Tax Receipt can be obtained in 4 simple steps:

Step 1:  Contact the Planning Division at 407.518.2146 to verify that you may be able to operate out of your home.  Only certain types of business may be operated from your home.  These regulations require the business to adhere to the following:

    • Must reside at the premise
    • Must be conducted entirely within the residence or accessory structure
    • Cannot have any client or customer presence on site
    • Cannot use employees or volunteers other than family members residing on premises
    • Cannot occupy more than 10% of the home, including storage
    • May not display signs advertising the business
    • May not use equipment not normally found within the household
    • Except for mail order, may not conduct sales or services on premises

Step 2: Download and complete the Business Tax Receipt Application.  Submit it along with the applicable fees to the Building Division in person, mail to City of Kissimmee, Building Division 101 Church Street, Suite 120, Kissimmee, FL  34741.

The following information is required to apply for a Home Business Tax Receipt:

      • Completed signed and notarized application
      • Property Owner authorization. 
      • Copy of the original sales tax ID certification (documents that are not official and are applications only, are not accepted)

Step 3: Staff will review the proposed request for compliance with City standards and will offer any applicable comments.

Step 4: Once approved, a Business Tax Receipt will be issued.  After receiving your BTR, it must be displayed conspicuously at your place of business and in such a manner as to be open to the view of the public and subject to inspection by all duly authorized officers of the City.

For Short Term Rental Occupancy:

If you plan to rent a dwelling in a short term rental overlay district, a Business Tax Receipt can be obtained in 4 simple steps:

Step 1:  Contact the Planning Division at 407.518.2146 to verify that you may be able to rent the property for short term occupancy.  Only properties within the Short Term Rental Overlay District and authorized by the properties Home Owner's Association, may rent to individuals for a period of less than 30 days. 

Step 2: Download and complete the Short Term Rental Application.  Submit it along with the applicable fees to the Building Division in person, mail to the City of Kissimmee, Building Division, 101 Church Street, Suite 120, Kissimmee, FL  34741.

The following information is required to apply for a License:

      • Copy of state sales tax ID certification.  Documents that are not official and are applications only, cannot be accepted;
      • Copy of Florida Hotel & Motel License; and
      • A copy of lease or rental agreement from owner OR a notarized Power of Attorney from the homeowner.

Step 3: Staff will review the proposed request for compliance with City standards and will offer any applicable comments.

Step 4: Once approved, a Short Term Rental Business Tax Receipt will be issued.  After receiving your BTR, it must be displayed conspicuously at your place of business and in such a manner as to be open to the view of the public and subject to inspection by all duly authorized officers of the City.

For Solicitors & Panhandlers:

If you wish to solicit for donations, services or the sale of goods or plan to travel from place to place to sell items, or request donation of money or other thing of value a license is required. 

Solicitation:  An individual traveling from place to place who takes or attempts to take orders for the sale of goods, merchandise, subscriptions or personal property of any nature.  

Step 1: Download and complete the Solicitor's Registration Application.  Submit it along with the applicable fees to the Building Division in person, mail to the City of Kissimmee, Building Division, 101 Church Street, Suite 120, Kissimmee, FL  34741.

Step 2: Staff will review the proposed request for compliance with City standards and will offer any applicable comments.

Step 3: Once approved, a Solicitor's License will be issued.

Panhandling: An individual requesting donation of money or other thing of value.

Step 1: Download and complete the Panhandler Registration Application.  Submit it along with the applicable fees to the Building Division in person, mail to the City of Kissimmee, Building Division, 101 Church Street, Suite 120, Kissimmee, FL  34741, or apply online via our Citizen Access portal.

Step 2: Staff will review the proposed request for compliance with City standards and will offer any applicable comments.

Step 3: Once approved, a Panhandler's License will be issued.

 How Do I Renew My Business Tax Receipt?
 To Renew Your Business Tax Receipt:

Business Tax Receipts expire annually on September 30 and must be renewed by October 1 to avoid penalties.  Courtesy renewal invoices are mailed to the current mailing and email address on record.  It is the responsibility of all businesses to maintain valid BTR and renew their license annually.  Failure to do so subjects the owner to late fees and closure of your business account.

Please review entirely the different renewal types and select appropriately to avoid any delays.

NO CHANGES TO YOUR BTR:  If there are NO CHANGES needed, please choose one of the following payment methods by September 30, 2015.

  • Renew online at online.kissimmee.org.  For a step by step tutorial please visit our Citizen Access instructions page.
  • Renew by mail by returning the LOWER portion of the BTR renewal invoice to:  City of Kissimmee, Building Division, 101 Church Street, Suite 120, Kissimmee, FL  34741-5054

Q:  What do I need to get my Business Tax Receipt?

Q:  What is a Business Tax Receipt (BTR)?

A:  A Business Tax Receipt, formerly known as Occupational License, is proof of payment of the business tax which is required before a business opens or starts.  A business operating without a BTR is subject to penalty.  Click HERE for more information.

Q:  Are there any zoning requirements?

A:  Yes, there are varies commercial, industrial and residential zones that dictate whether a particular use could be allowed.  It is important to check to see if the location you choose allows for the type of business you want to do.  Please contact the Planning Division at 407.518.2146 to check your zoning.

Q:  How much does a BTR cost?

A:  Fees vary from one classification to another and many fees are based on variables.  New business tax receipts are prorated if the business starts on or after January.  The cost is reduced by 10% of the regular fee in January and by an additional 10% each month through September.  To acquire these fees, please contact the Building Division at 407.518.2379 or permitting@kissimmee.org.

Q:  When will my BTR expire?

A:  BTR's are valid each year from October 1 - September 30.  All BTR's expire on September 30th of each year.  Renewals made AFTER September 30 are delinquent and are subject to penalty.  Beginning October 1 delinquent penalties will be assessed within increases the first day of each additional late month as follows:  10% of the first month plus 5% each additional month up to a max of 25%. 

Q:  Do I need just one BTR for my business?

A:  You will need a BTR for each location you operate your business from, and one for each type of business you conduct.

Q:  Do I also need a county BTR?

A:  Yes.  A business must have both a City and County business tax receipt.  To guarantee zoning and building regulations are met, the City BTR must be obtained first.  The county BTR can be obtained afterward contacting the Osceola County Tax Collector's Office at 407.742.4000 or visit their main office at 2501 E. Irlo Bronson Memorial Hwy., Kissimmee.

Q:  How do I renew my BTR?

A:  Courtesy invoices are mailed in July/September and are due no later than October 1 to avoid penalties of up to 25%.  These invoices are a courtesy and failure to receive an invoice is not an excuse for nonpayment.  After February 1 an additional penalty of $250 will be applied to any unpaid business tax receipt.  Please click HERE for the renewal process.

Q:  Are BTR's transferrable?

A:  Yes.  BTR's can be transferred to a new owner or to a new location.  To get more information or to make a transfer, please contact the Building Division at 407.518.2379 or permitting@kissimmee.org.

Q:  How long does the process take?

A:  All applications must be reviewed and approved by various City agencies before a BTR can be issued.  Depended upon the situation, reviews can take up to 2 weeks.

Q:  Do I need a Fictitious name?

A:  You can use your FULL name as the business or your FULL name and an extension (i.e. John Doe Enterprises) and won't need to register your name with the state.  However, if you choose to use first, last, initials or anything else besides your full name, you will need to register with the state at www.sunbiz.org (any corporations can be registered at this site as well).  If you choose to register a fictitious name, we will need the certificate of the fictitious name or your articles of corporation.

Q:  How do I get an Federal ID # or Sales tax #?

A:  For an Federal ID# you contact the IRS at 1.800.829.1040 or for forms 1.800.829.3676.  For sales tax ID, contact the Florida Department of Revenue at 407.475.1200 or 1.800.352.3671.

Q:  Do I need a BTR to work from home or to operate an internet base business from home?

A:  Yes.  All businesses must obtain a Kissimmee Business Tax Receipt.  Please review the Home Businesses section this webpage to find out more information.

Q:  Can I sell items on the roadside/sidewalks?

A:  No.  Roadside vending is not allowed in the city.  For more information please contact the Planning Division at 407.518.2146.

Q:  What if I bought a business which already has a valid BTR?

A:  You must still apply for your own local BTR in you name.  We must see a bill of sale and the change of ownership of the business name through www.sunbiz.org (unless the name of the business changes) and if required we must see any state licenses in your name as well.  We also need a lease in the new owners name.

Q:  What if my business closes?

A:  Notify the Building Division at 407.518.2379 or permitting@kissimmee.org to close your business account.  Otherwise, if not, renewals and late penalty fees will continue to accrue.

Other information that may be helpful:

After receiving your BTR, it must be displayed conspicuously at your place of business and in such a manner as to be open to the view of the public and subject to inspection by all duly authorized officers of the City.

The City of Kissimmee online payment services is available 24 hours a day.  However there may be instances where maintenance activities may cause the program to be unavailable.  If your business transaction has a due date associated with it, it is your responsibility to ensure that your payment is made by that due date.  Delays cause by unavailability of any online service DO NOT warrant the reversal of late fees, as payments may also be made by other means, such as postal mail and walk-in during normal business hours.  Online payments are designed to ensure the privacy of your credit card information, name, address, email and other information you provide to us.
